Massachusetts Bay Transportation Authority.
Agency history record.
St 1894, c 548, as amended by St 1897, c 500, incorporated
the Boston Elevated Railway Company, to construct or lease and
operate public transportation on street and elevated railway
lines in Boston and adjoining communities, including in
subways constructed in conjunction with the Boston Transit
Commission. Sp St 1918, c 159 provided for public operation
of the company through a gubernatorially appointed board of
trustees.
St 1929, c 383 designated the company's scope of operations
as a Metropolitan Transit District, Boston and thirteen
surrounding municipalities, governed by trustees and a
Metropolitan Transit Council. The district was administered
by a Metropolitan Transit Dept., absorbing powers of the
Boston Transit Dept. it acquired when the Boston Transit
Commission was abolished by Sp St 1918, c 185.
St 1931, c 333 provided for public operation of the company
until 1959, but St 1947, c 544 replaced the company and its
trustees with and reconstituted the Metropolitan Transit
District communities (although district trustees continued) as
the Metropolitan Transit Authority, a body politic and
corporate and a political subdivision of the Commonwealth,
also governed by a board of public trustees. St 1964, c 563
replaced the authority with the Massachusetts Bay
Transportation Authority, governed by a public board of
directors and an advisory board, representing each of the
fourteen district municipalities and an additional sixty-four.
Its functions are currently described in MGLA c 161A.

Agency history record.
St 1919, c 350, ss 111-116 established the Dept. of Public
Works, superseding the Massachusetts Highway Commission and
the Commission on Waterways and Public Lands. The department
was organized into a Division of Highways and a Division of
Waterways and Public Lands. These divisions were consolidated
pursuant to St 1927, c 297, which reorganized the department.
A separate Division of Waterways was reestablished per St
1938, c 407. A Division of Public Beaches was established per
St 1953, c 666, but it was abolished and its functions
absorbed by the Division of Waterways per St 1958, c 640, ss
1-6 (from which they were then transferred to the Division of
Forests and Parks in the Dept. of Natural Resources per St
1968, c 501, ss 1, 5-6)
Per St 1959, c 416, the Mass Transportation Commission was
established within the department and abolished per St 1964, c
636, s 12. St 1963, c 821 again reorganized the department
under the supervision and control of the Public Works
Commission, adding divisions of administrative services,
highway engineering, highway construction, and highway
maintenance. St 1964, c 563, s 1 added a Bureau of
Transportation Planning and Development.
St 1969, c 704, s 19 placed the department within the
Executive Office of Transportation and Construction except for
the Registry of Motor Vehicles (established per St 1946, c
234), removed from the department and placed in the Executive
Office of Public Safety (ss 18, 20); the registry's Division
of Motorboats (established per St 1963, c 821), placed in the
Executive Office of Public Safety (s 18), renamed Division of
Motor and Recreational Vehicles per St 1971, c 103, ss 1-2,
and transferred from the Dept. of Public Works to the Dept. of
Fisheries, Wildlife, and Recreational Vehicles per St 1974, c
806, s 1 and St 1975, c 706, s 17; and the Outdoor Advertising
Board and Outdoor Advertising Division (established per St
1963, c 821), placed in the Executive Office of Environmental
Affairs (s 15) and transferred from the Dept. of Public Works
to the Dept. of Environmental Quality Engineering per St 1974,
c 806, s 1.
The Division of Waterways was transferred to the Dept. of
Environmental Quality Engineering per St 1974, c 806, s 1 and
St 1975, c 706, s 14. The Bureau of Solid Waste Disposal
(established per St 1969, c 834, s 1) was transferred to the
Dept. of Environmental Management per St 1974, c 806, s 1.
St 1991, c 552, ss 6-7 (effective 1992) renamed the
department as the Dept. of Highways (commonly called
Massachusetts Highway Department) and the Public Works
Commission as the Highways Commission.

development and maintenance of all state highways, are

1992, the Massachusetts Highway Department, have been
responsible for development and maintenance of all state
highways and bridges in the Commonwealth. Additionally,
pursuant to MGLA c 90, s 34, they have directed the use of the
state Highway Fund to assist counties and municipalities in
construction and maintenance of county and town roads. State
aid maps were annotated by the department's chief engineer to
record such projects. U.S. Geological Survey maps include

St 1960, c 635 (amended by St 1962, c 685) established the
Government Center Commission within the Dept. of Public
Works, consisting of three gubernatorial appointees serving
five-year terms. The commission, after consultation with the
Boston Redevelopment Authority, was to acquire land in Boston,
and enter into contracts for the erection of a state office
building, and of a health, welfare, and education service
center consisting of a mental health center and state
laboratories building; an employment security building; and a
health, welfare, and education building. The completed
buildings were named the Leverett Saltonstall Building, the
John W. McCormack Building, the Lindemann Mental Health
Center, and the Charles Hurley Building (employment security)
Originally the commission was to dissolve at the expiration
of its members' terms. St 1964, c 649 provided for
appointment of their successors for five years, and
dissolution in 1970 or on completion of duties, whichever
occurred first. St 1970, c 596 extended the 1970 deadline to
1975.

St 1952, c 354 created the Massachusetts Turnpike
Authority, consisting of three gubernatorial appointees
serving staggered eight-year terms, to construct, reconstruct,
maintain, repair, and operate the Massachusetts Turnpike from
the New York state line to the vicinity of Boston (later
extended to downtown Boston); its powers include the taking of
state highways, acquisition of real property by purchase or
eminent domain, issuance of revenue bonds, and collection of
tolls.
St 1958, c 598 extended its jurisdiction to maintenance and
operation of the vehicular tunnel (Sumner) between Boston
proper and East Boston, and the construction of a second such
tunnel (Callahan). The authority is designated a body politic
and corporate and a public instrumentality, placed in but not
subject to general jurisdiction of the Dept. of Public Works
(Massachusetts Highway Dept. from 1992). St 1969, c 704, s 3
also placed it within the Executive Office of Transportation
and Construction. Its functions are currently described in
MGLA c 81 App s 1-1 et seq.

Agency history record.
St 1956, c 465 created the Massachusetts Port Authority
(now commonly known as Massport), consisting of seven
gubernatorial appointees serving staggered seven-year terms,
to acquire through refinancing and to maintain and operate the
following: from the City of Boston, the Sumner Tunnel from
Boston to East Boston (this function, and that of constructing
a second such tunnel were transferred by St 1958, c 598 and c
599 to the Massachusetts Turnpike Authority); from the Mystic
River Bridge Authority (to be dissolved), the Mystic River
(now Tobin) Bridge; from the Commonwealth, commercial
facilities at the General Edward Lawrence Logan International
Airport and Lawrence G. Hanscom Field; from the Port of Boston
Commission (to be dissolved), the lands and piers acquired and
leased by the Commonwealth in the Port of Boston.
The authority's powers include acquisition of real property
by purchase or eminent domain, issuance of revenue bonds, and
collection of tolls. The authority is designated a body
politic and corporate and a public instrumentality, placed in
but not subject to general jurisdiction of the Dept. of Public
Works (Massachusetts Highway Department from 1992). St 1969,
c 704, s 3 also placed it within the Executive Office of
Transportation and Construction. Its functions are currently
described in MGLA c 91 App s 1-1 et seq.

Summary: The Massachusetts Port Authority (Massport),
responsible for maintaining the Mystic River (later Tobin)
Bridge from Boston to Chelsea, Massachusetts, was authorized
by St 1964, c 682 to construct connections between that bridge
and another high-level bridge to be constructed over the
Charles River between Leverett Circle, Boston proper, and City
Square, Charlestown, by the Metropolitan District Commission
(MDC); cost of the project was to be divided between the two
agencies. Project files were created by the authority's
research/planning division in the course of interagency
planning for the proposed bridge.
Files contain correspondence, legislation, interagency and
engineering agreements, cost estimates, blueprints, traffic
pattern graphs, press releases, and clippings; also minutes of
the MDC's North Terminal Technical Advisory Committee. The
project was effectively abandoned by 1973, although attempts
to repeal enabling legislation from 1971 to 1980 were
unsuccessful.

Massachusetts Aeronautics Commission.
Agency history record.
St 1922, c 534 entrusted regulation of operation of
aircraft to the registrar of motor vehicles, who appointed an
advisory board of aeronautical experts to determine fitness
for pilot licenses. St 1939, c 393 established the
Massachusetts Aeronautics Commission, serving under the
governor, to supervise and control all aeronautical activities
and facilities in the Commonwealth. It was reconstituted by
St 1946, c 583; by St 1969, c 704, s 3 it was placed within
the Executive Office of Transportation and Construction. Its
jurisdiction includes public use airports, seaplane bases, and
private use landing areas. It is responsible for airport
development and improvements, aviation safety, aircraft
accident investigation, navigational aids, and statewide
aviation planning. It certifies airports and heliports,
licenses airport managers, conducts annual airport
inspections, and enforces safety regulations. Its functions
are currently described in MGLA c 6, ss 57-59 and c 90, ss
39-40.

Mystic River Bridge Authority (Mass.)
Agency history record.
St 1946, c 562 created the Mystic River Bridge Authority as
a body politic and corporate and a public instrumentality
consisting of four gubernatorial appointees serving staggered
eight-year terms and the state commissioner of public works ex
officio, to construct, maintain, repair, and operate the
Mystic River (now Tobin) Bridge between Boston and Chelsea,
Massachusetts; its powers included the acquisition of real
property by purchase or eminent domain, issuance of revenue
bonds, and collection of tolls. St 1956, c 465, which created
the Massachusetts Port Authority, provided (as amended by St
1958, c 599) for the refunding by it of outstanding Mystic
River Bridge revenue bonds, the subsequent dissolution of the
Mystic River Bridge Authority, and the vesting of bridge title
with the Massachusetts Port Authority, which process was
completed in Feb. 1959.
